General Terms and Conditions

Acceptance of terms

Access to and use of this website confers the status of user and implies full acceptance of these terms. The trademarks, logos, illustrations and contents of this website are the property of Dagachi and are protected by the corresponding intellectual and industrial property rights.

Registration

The STUDENT is interested in receiving the teaching services offered by DAGACHI, consisting of a Korean language course for a determined duration, the price, content, characteristics and requirements of which he/she is aware of and accepts, submitting to the rules, discipline and academic organisation of DAGACHI.

Course fees and method of payment

In order to register for classes, both live videoconference and recorded courses, the student must pay in advance through the payment gateways that we provide on our website, bank transfer or Bizum. It is strongly recommended to contact the academy, by phone or email, before booking for the first time, in order to be able to advise the student in the choice of courses.

THE STUDENT undertakes to pay for the course corresponding to the determined duration of the course. In the case of deferred payment, if he/she wishes to continue with the course, the STUDENT must pay the total remaining amount in the manner and by the deadlines indicated on the website or in the information brochure, without, where applicable, the commitment to pay, in full or in part, by a third party exonerating him/her from this responsibility, in which case he/she shall be jointly and severally liable. DAGACHI shall provide the STUDENT with an invoice, receipt or proof of payment or payments made in accordance with the corresponding legislation. Failure to pay any of the amounts by the dates and deadlines agreed in this contract will result in the DISMISSAL of the PUPIL from the course. THE STUDENT will not be able to start or continue the course until payment has been made.

Cancellation or modification of course timetable

DAGACHI reserves the right to cancel any group course if a minimum of 4 students have not registered and paid for the entire course. Similarly, the dates and times of the course may be adapted or modified, always with notice to students already enrolled in the event that the course modality changes from group (4 students) to semi-private (2 to 3 people). In both cases, THE STUDENT may request a refund of the full amount of the course if it has not started or the proportional part of the course that has not been given.

Right of withdrawal

The STUDENT may freely withdraw from the course and demand a refund of the full amount of the course if he/she requests it MORE THAN TEN days prior to the start date of the course. In the ten days prior to the start of the course, THE STUDENT may withdraw with the consequent refund of 50% of the total amount of the course or request the change of the course for a different or subsequent course of the same amount to be taken within 6 months after the start date of the course initially contracted. In the event of cancellation, THE STUDENT must contact the DAGACHI secretary's office by sending an e-mail to the DAGACHI at: info@academiadagachi.com stating the name and surname, the bank account number where the STUDENT wishes to receive the refund and the reason for the cancellation.

Service guarantee

DAGACHI has stipulated a minimum structured content to be taught in each course. However, DAGACHI does not undertake to ensure that these objectives are achieved, but rather that the pace of the class will determine whether or not this is achieved. DAGACHI will provide basic material for the first few weeks of the course, which is included in the price of the course.

Technical conditions

In live online courses, the student attends class from home via videoconference, participating in a session similar to the one that would be given in person. Participation in these courses is subject to both the general terms and conditions and the following specific conditions:

  1. DAGACHI will ensure compliance with the technical requirements that depend directly on the company in each class. In the event of a technical breakdown that makes it impossible to teach a class, DAGACHI undertakes to make up the class at a similar time to that established at the start of the course.
  2. DAGACHI will ensure that the video conferencing software is compatible with the most commonly used operating systems: Windows, OS X, Android and iOS. DAGACHI cannot be held responsible in the event of compatibility problems with devices using operating systems other than these.
  3. The STUDENT must have a high-speed internet connection and a videoconferencing system to follow the classes, consisting of either a webcam, microphone and a desktop or laptop computer, or a mobile device compatible with the videoconferencing system used in the classes. DAGACHI shall not be held responsible in the event that the STUDENT does not have the essential elements for monitoring the classes at the start of the course.
  4. DAGACHI will provide the STUDENT with the access details for the course once the STUDENT has paid for it, as well as the complementary material necessary for the development of the classes. Public communication of this information and resale of the course by the STUDENT is strictly prohibited.
  5. The STUDENT must be present at the videoconference class on the course days and times stipulated by DAGACHI. The teacher reserves the right to admit a STUDENT if he/she is more than 15 minutes late. This delay will be the responsibility of the PUPIL and DAGACHI does not undertake to make it up in the case of private and semi-private classes.
  6. DAGACHI is not responsible for any technical problems that may occur on the part of the STUDENT that make it impossible for him/her to attend the videoconference: internet connection problems or software or hardware problems on the part of the STUDENT.

Issuance of accreditation diplomas

At the end of the contract, the PUPIL who has attended at least 90% of the classes may request a diploma accrediting the knowledge acquired or level reached. If the level of knowledge is not satisfactory, the STUDENT may also request a certificate of attendance from DAGACHI, stating the number of classes attended.

Confidentiality and protection of the education system

The PUPIL is subject to the following obligations of confidentiality of the material he/she receives or to which he/she is given access throughout the duration of this contract:

  1. You may not disclose or provide to any third party, either orally or in writing, any material or information you receive from DAGACHI, except with the prior written consent or authorisation of DAGACHI.
  2. Not to reproduce, by any means (photocopies, duplicates, screen captures and other processes made possible by technology) any type of material that DAGACHI gives you or makes available to you for the purpose of your learning.
  3. Not to disclose or publish by any means without the prior written permission of DAGACHI any information, vocabulary, lists, learning methods etc., which DAGACHI provides or makes available to you.
  4. Not to record classes under any circumstances, even if it is only for the PUPIL's learning purposes.
  5. Not to delete or reproduce or modify any copyright or proprietary rights legends that may appear on any documentation, material or website provided or made available to you by DAGACHI.
  6. Given the individual and non-transferable nature of the DAGACHI platform, ALUMNI may not give access or transfer their account to any other person. Likewise, he/she may not carry out the exercises, share the learning media or similar with any other person.

Failure to comply with any of the aforementioned obligations shall give rise to liability of any kind, including criminal liability, in which the STUDENT may have incurred, regardless of the indemnification in favour of DAGACHI for the damages that such non-compliance may have caused.

Protection of personal data

For the purposes of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, Esperanza Macarena del Campo Mendoza, as data controller, hereby informs the STUDENT that his/her personal data provided to DAGACHI will be processed in a file whose purpose will be the execution, assurance, management and monitoring of the training activity in which he/she participates.

Extension of the contract

This contract shall remain in force for the entire time the STUDENT is studying a language at DAGACHI and shall therefore be applicable to any extensions that THE STUDENT wishes to contract with DAGACHI without it being necessary to sign a new contract as long as DAGACHI understands that there has been no change in the terms of the contract, including the change of price.

Applicable law and jurisdiction

These terms and conditions shall be governed by and construed in accordance with Spanish law. In the event of any dispute relating to the interpretation, execution or fulfilment of these conditions, both parties agree to submit to the jurisdiction of the corresponding courts and tribunals in accordance with current legislation.

By contracting any of the services offered on this website, the student expressly accepts these legal conditions.
